Terms of Service

This is a working draft. Pocket Femboy is still being built, and this page may change before launch — the date above is the current revision.

These Terms of Service ("Terms") are an agreement between you and Pocket Femboy ("Pocket Femboy", "we", "us") covering your use of the Pocket Femboy app, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Community Guidelines (which are part of these Terms), and our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use Pocket Femboy

  • You must be at least 18 years old. No exceptions.
  • You must be able to form a binding contract where you live, and not be barred from the Service by law.
  • You must not have been banned from the Service before.

We ask for your birthdate at signup and use automated systems to look for signs that a user may be under 18. We may restrict or close any account we believe belongs to a minor.

2. Your account

  • Give accurate information, including your real birthdate.
  • Keep your sign-in details secure. You're responsible for activity on your account.
  • Your account is personal to you. Don't share, sell, or transfer it.

3. AI characters

  • Characters are fictional and powered by AI. No person writes their messages. A relationship with a character is a fictional experience, not a relationship with a real person.
  • AI makes mistakes. Replies can be inaccurate, inconsistent, or unexpected. Don't rely on them for anything important.
  • Not professional help or a crisis service. Characters aren't therapists, doctors, lawyers, or financial advisors. If you're in crisis, contact emergency services or see our Safety page.
  • Characters may message you first, including through notifications if you allow them.
  • Safety systems. Messages are checked automatically. Some messages get a safety response, such as crisis resources, instead of a character reply, and prohibited content is blocked.
  • Usage limits. To keep the Service running, we may limit how much you can use it in a given period. Limits can differ by plan.
  • Don't try to trick characters or our systems into producing content our Community Guidelines don't allow.

4. Your content

"Your content" means what you send through the Service, such as messages and voice input. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit it, including to the AI and other service providers described in the Privacy Policy, only to operate and provide the Service to you. The license ends when your content is deleted, except as described in the Privacy Policy.

You're responsible for what you send. Don't send anything you don't have the right to share, or that breaks the law or our Community Guidelines. We may block or remove content that breaks these Terms.

You may use characters' replies for your own personal, non-commercial purposes. The characters themselves, including their names, personalities, stories, and artwork, belong to us.

5. Community Guidelines

Our Community Guidelines, including our Child Safety Standards, explain what's allowed. Breaking them can lead to blocked messages, restrictions, suspension, or a permanent ban.

6. Subscriptions and payments

  • Pocket Femboy offers paid plans, currently Plus and Premium. What each plan includes, and its price, are shown in the app before you buy.
  • Subscriptions are bought through the Apple App Store or Google Play, and that store's terms also apply. Apple or Google handles payment.
  • Subscriptions renew automatically at the end of each billing period until you cancel in your App Store or Google Play subscription settings. To avoid being charged for the next period, cancel before it renews (for the App Store, at least 24 hours before the current period ends).
  • Deleting the app or your account doesn't cancel your subscription.
  • Refunds are handled by Apple or Google under their policies. We can't refund store purchases ourselves.
  • We may change plans, features, or prices. Price changes for an existing subscription follow the store's rules, including advance notice and, where required, your consent.

7. Deleting your account, suspension, and termination

  • You can stop using the Service and delete your account at any time, from the app or our account deletion page. A deleted account is pending for 14 days, and signing back in during that time restores it. After that, it's permanently deleted.
  • We may restrict, suspend, or close your account, or block content, if we reasonably believe you've broken these Terms or the Community Guidelines, if you appear to be under 18, if the law requires it, or to protect the Service or other people.
  • If you think we made a mistake, email support@pocketfemboy.com and we'll review it. Bans for breaking our Child Safety Standards are final after review.
  • If we close your account, don't create a new one without our permission.

8. Our intellectual property

The Service, including the Pocket Femboy name, characters, artwork, design, and software, belongs to Pocket Femboy or its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. Don't copy, modify, distribute, sell, or reverse-engineer the Service; don't scrape it or access it with automated tools outside its normal interfaces; and don't use it to build a competing product or to train AI models.

If you believe something on the Service infringes your copyright, email support@pocketfemboy.com with a description of the work, where it appears, your contact information, and a statement that you believe in good faith the use isn't authorized.

9. Apple and Google

If you got the app from the Apple App Store:

  • These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app doesn't conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent allowed by law, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for addressing any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • We, not Apple, are responsible for handling any claim that the app infringes someone's intellectual property rights.
  • You confirm you're not located in a country under a US government embargo or designated as supporting terrorism, and you're not on any US government list of prohibited or restricted parties.
  • You must follow applicable third-party terms, such as your wireless carrier's, when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you got the app from Google Play, Google Play's terms also apply to your download and purchases.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CHARACTERS ARE AI, NOT REAL PEOPLE. WE DON'T WARRANT THAT AI-GENERATED CONTENT IS ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, Pocket Femboy WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE OR FROM AI-GENERATED CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold Pocket Femboy harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms, any law, or anyone else's rights.

13. Governing law and disputes

These Terms are governed by the laws of Pennsylvania, without regard to conflict-of-law rules. Before filing any claim, you agree to email support@pocketfemboy.com and give us 30 days to try to resolve the dispute informally. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.

14. General

  • Entire agreement. These Terms, the Community Guidelines, and the Privacy Policy are the whole agreement between you and Pocket Femboy about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a provision, we can still enforce it later.
  • Assignment. You can't transfer these Terms. We may transfer them as part of a merger, acquisition, or sale of assets, or by law.
  • Survival. Sections 4 and 8 through 14 survive the end of your account or these Terms.

15. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you in the app or by email before it takes effect. If you keep using the Service after that, the updated Terms apply. If you don't agree, stop using the Service and delete your account.
